Welcome to 3D Print Factory (“we”, “us”, “our”). We operate this store and website, including all related information, content, features, tools, products, and services (the “Services”). Our Store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (the “Terms”), together with any policies referenced here, describe your rights and responsibilities when you use the Services. By visiting, interacting with, or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. ACCESS AND ACCOUNT

You represent that you are at least the age of majority in your place of residence and, if applicable, you consent to any minor dependents using the Services on devices you own or manage. You may be asked to provide accurate and current information (e.g., email, billing, payment, shipping). You are solely responsible for safeguarding your account credentials and all activity under your account. You may not transfer, sell, assign, or license your account.

2. OUR PRODUCTS (INCLUDING CUSTOM & ON-DEMAND 3D PRINTS)

We make reasonable efforts to display products accurately, but colours/appearance can vary due to device settings. We do not warrant that the appearance or quality will meet your expectations or match any renders.

Custom & on-demand prints. Many products are made to order from files you submit. We print models exactly as provided and are not responsible for design, scale, functionality, fitness for purpose, safety, or IP clearance of customer-supplied files. You confirm you have the rights to use any content you submit. See Section 13 (Prohibited Uses) and our Return & Refund Policy.

We may change descriptions, discontinue items, or limit quantities at any time.

3. ORDERS

Your order is an offer to purchase; we may accept or decline at our discretion. Orders are accepted once payment is received and we confirm acceptance. Please review carefully before submitting—cancellations may not be possible after acceptance. If we decline or modify an order, we’ll try to notify you via the contact details provided.

Your purchases are subject to our Return & Refund Policy. You represent purchases are for personal/household use and not for resale or export.

4. PRICES AND BILLING

Prices, discounts, and promotions may change without notice. The price charged is the price at checkout/confirmation and excludes taxes, shipping, handling, customs, and import charges unless stated otherwise. Promotions may have separate terms; if there’s a conflict, promotion terms govern.

You agree to provide current and accurate payment/account information and authorise charges for the posted prices plus applicable fees and taxes.

5. SHIPPING AND DELIVERY

Delivery times are estimates and not guaranteed. We are not responsible for carrier delays, customs processing, or events beyond our control. Title and risk of loss pass to you upon transfer to the carrier. For details, see our Shipping Policy.

6. INTELLECTUAL PROPERTY

All content and the design/arrangement of the Services are owned by 3D Print Factory, its affiliates, or licensors and are protected by applicable IP laws. You may use the Services for personal, non-commercial use only. Except as permitted by law or with our prior written consent, you must not reproduce, distribute, modify, create derivatives, publicly display, or exploit the Services or content. Our names, logos, and marks are our trademarks; other marks belong to their owners.

7. OPTIONAL TOOLS

We may provide access to third-party tools “as is” and “as available” without warranties or endorsements. Use is at your own risk and subject to the third party’s terms.

8. THIRD-PARTY LINKS

Third-party websites or materials accessed via the Services are outside our control. We are not responsible for their content, policies, or any loss/damage arising from their use. Review third-party terms before transacting.

9. RELATIONSHIP WITH SHOPIFY

Our Store is powered by Shopify. Sales and purchases are between you and 3D Print Factory. Shopify is not responsible for your transactions with us, and you release Shopify and its affiliates from claims arising from such transactions.

10. PRIVACY

Personal information collected via the Services is handled under our Privacy Policy. Because our Services are hosted by Shopify, certain data is also processed by Shopify per the Shopify Privacy Policy and the Shopify Privacy Portal.

11. FEEDBACK

If you submit ideas, suggestions, reviews, or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish, and display such Feedback for any purpose. You represent you have the necessary rights and that your Feedback complies with these Terms and applicable law.

12. ERRORS, INACCURACIES AND OMISSIONS

Information on the Services may contain errors or omissions (e.g., descriptions, pricing, availability). We may correct or update information or cancel orders where information is inaccurate, at any time and without notice (including after you submit an order).

13. PROHIBITED USES

You must not use the Services for unlawful or malicious purposes; to infringe IP rights; to harass, defame, or harm others; to transmit misleading, obscene, or malicious content; to spam; to introduce malware; to scrape data; or to bypass security. You must not upload files that violate rights or laws, or submit designs intended for dangerous, unlawful, or prohibited items. We may suspend/terminate accounts for violations.

14. TERMINATION

We may suspend or terminate access to the Services at any time. Provisions that by nature survive termination (including Intellectual Property, Feedback, Disclaimers, Limitation of Liability, Indemnification, Severability, Governing Law, and Privacy) will continue to apply.

15. DISCLAIMER OF WARRANTIES

Except as expressly stated by us, the Services and all products are provided “as is” and “as available,” without warranties of any kind (express or implied), including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant uninterrupted, timely, secure, or error-free operation, or that defects will be corrected. Your use is at your own risk. Some jurisdictions do not allow certain disclaimers—those limits apply to the extent required by law.

16. LIMITATION OF LIABILITY

To the fullest extent permitted by law, in no case shall 3D Print Factory or our officers, employees, affiliates, agents, contractors, service providers, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages (including lost profits, revenue, savings, data, or replacement costs) arising from your use of the Services or products, even if advised of the possibility. Nothing in these Terms excludes, restricts, or modifies rights and remedies under the Australian Consumer Law that cannot be excluded.

17. INDEMNIFICATION

You agree to indemnify and hold harmless 3D Print Factory and our affiliates, officers, employees, agents, contractors, licensors, and service providers from claims, losses, and expenses (including reasonable legal fees) arising out of your breach of these Terms, violation of law or third-party rights, or misuse of the Services.

18. SEVERABILITY

If any provision is unlawful, void, or unenforceable, the remainder remains in effect to the fullest extent permitted by law.

19. WAIVER; ENTIRE AGREEMENT

Failure to enforce a provision is not a waiver. These Terms and our posted policies constitute the entire agreement between you and us regarding the Services and supersede prior agreements.

20. ASSIGNMENT

You may not assign or transfer these Terms without our prior written consent. We may assign or transfer these Terms without notice.

21. GOVERNING LAW

These Terms and any disputes are governed by the laws of Queensland, Australia. You and 3D Print Factory submit to the non-exclusive jurisdiction of the courts of Queensland.

22. HEADINGS

Headings are for convenience only and do not affect interpretation.

23. CHANGES TO TERMS

We may update these Terms from time to time. The “Last updated” date reflects the latest version. Material changes will be notified as required by law, and changes take effect when posted. Your continued use of the Services constitutes acceptance.
